Who Decides Judgement

Okay.... I'm no expert on all things PlaneScape.. so bear with me...

When it comes to deciding of punishment... who gets final say? I know the Harmonium arrests those they think deserve such. I also know the Guvners decide innocence and guilt. I've always thought that the Red Death decides appropriate punishment but I've been noticing that the Guvners have been leveling punishment instead. If the MercyKillers have to adhere to anothers vision of penalty... doesn't that take away from their ability to "Kill Mercy"?

So... who decides punishment... Guvners or Red Death?

It should be the Mercykillers that determine punishment based on the crime(s), Guvners only determine guilt.

That is actually technically true. However, I would like to put two things in perspective regarding this.

Firstly, the Harmonium, Guvners, and Mercykillers are all aligned. So it is possible that the Mercykillers would respect a sentencing decision given by an actual Guvner judge (and who knows, the judge may have been in contact with Alisohn or Arwyl before the trial regarding sentencing guidelines approved by the Red Death, and upon guilt is actually handing down a sentencing decision made beforehand by the Mercykillers).

Also, nobody's "punishment" will be left in the hands of other players, mainly because we are not a forced-permadeath server, unless the "guilty" party specifically approves of this via OOC arrangement (yes, I realize that some players are going to want to act out scenes of imprisonment and worse, and they are free to do so if all parties agree).

Up until recently, we only had the Harmonium available to play out legal issues. At this point, the courthouse is available to DMs for use, but no permanent Guvner or Mercykiller NPCs are actually set up in the server (I used canon NPCs for the trial of Raifael Degare, but had to make those from existing NPCs).

That will change when the update hits, as the Prison and an updated Courthouse will be available and open for those players who wish to make use of them (players RPing upper-level Mercykillers who need them will be provided with prison keys, for example). Still, nobody wants to have "I'm in a bad mood so your character will be stuck in a cell forever, go play someone else now" RP.

Cool.. I only needed to know what faction makes the decision of punishment. I didn't want to RP my Mercykiller as being held to another factions sense of mercy. I wanted to know whatever the punishment given by the DM's that I can RP as it being made by my leaders and act accordingly...
