Trial: Emeraldin Undren

Word quickly spreads that Emeraldin Undren aka "Emmy" will soon stand trial for various charges filed by Fraternity of Order Factotum Green. Presently Emmy is being held in the temporary cells in the Barracks while Green assembles his case against the redheaded halfling.

As per the usual, character witnesses are being called for, as well as a defense attorney for the accused.

A request is sent by Civil Judge A7 Seph as to the particulars of the trial request and to the reasons of the current incarceration. A court request for the authorized warrants permitting pre-trial incarceration are also included.

My concern in this matter is that you are spearheading this investigation as a prosecuting attorney and not as a judge. As a prosecuting attorney you are permitted to arrange evidence and witnesses but are not permitted to decide whether trial will be held or what happens to the accused before said trial. That is the realm of a judge who would hear your arguments during a preliminary hearing and who must sign off on your requests for such motions. If you are acting as a judge then you are skirting on the edge of conflict of interest as it is not your task to amass said evidence nor testimony against the accused and might be seen as interfering in matters concerning the prosecution or defence.


The Judge for the trial will be decided by a superior of yours and not by you yourself so consideration for my candidacy is a moot point. Prosecutors, nor defence attorneys are permitted to pick and choose who they wish so until such a time as a Bureau Chief assigns an overseeing judge to the case I will act as interim judge to expedite things for both you and the accused. Should the Bureau Chief decide another will oversee your trial then I will step aside as requested.


That being said;


Due to your diligence on ensuring that the evidence warrants a trial, authorization to proceed to the level of preliminary hearing is approved.


However...


There are no grounds in which to detain the accused any further. The accused does not represent a flight risk nor are the charges serious enough to warrant holding her further. Please issue her a promise to appear and have her released immediately.


Should you feel my decisions are unfair to either you or the accused you are free to appeal to a Bureau Chief to have them overruled.

[Green doesn't reply this time, but instead there's a great show of activity between his office, the Harmonium Barracks where Emeraldin is being temporarily held, a bustle back to Green's office, some commotion in a nearby notary's office, more Harmonium running back and forth between Green's office and the Barracks, and finally the release of Emeraldin Undren until her trial date on the condition that she will not leave Sigil proper until her trial is concluded.

Harmonium are instructed to keep an eye on her activities and immediately alert Green should she exhibit any sign at all of leaving Sigil or fleeing into Undersigil.

Garen Seph later receives a small unmarked slip if paper reading: This will not be forgotten.]

The note would simply be filed with all the other threatening notes he's recieved from his participation in the d'Kridis trial and every other trial thereafter. It would ignored like all the others

then seems jall has the luck to meet emeraldine right there where she was waiting as she's released. she greets her quietly with a smile, then as they walk out asks her what she intends to do ///might also wait to meet ya IG now then, unless some other forum rp comes out//

What do you mean? I intend to wait until my trial date, of course some of the charges levied against me are false. I never threatened anyone, I never removed any evidence from the crime scene as it is still there, and while I was difficult I did eventually comply with Factorum Green.
