OOC: not sure, but maybe a petition forwarded by witnesses, via private letters, isn't exactly mere pubblic opinion.
also, still OOC: quote from the topic ''trial requested: hildmor d'kridis'' in guvner faction board
weylyn:
QUOTE
In light of this I submit the following motions in preparation for the trial:
Hildmor d'Kridis to be released on bail
It shall be impossible for my client to adequately prepare his defense within the confines of a Harmonium cell. The previous trials have shown that the Harmonium is not without malice towards my client, and does not feel that their presence will enable him the privacy and resources necessary to direct his defense. To remedy the issue I submit that my client should be released on bail, subject to a geas compelling him to attend trial should the court demand such.
END QUOTE
first of all what ''malice'' here means? reasonable suspects about client cheating and security measures? or bad treatment, injuries done, denial of requests, etc to the prisoner?
but i think additional measures can be taken inside the barracks themselves to assure harmonium do not interfere with his malice too much about privacy and resources? so the client wouldn't need at all to be out of the cell to prepare himself properly...
and above all: if the defense has the right to let hildmor out on bail due to...malice, and hildmor's lawyer's opinions about assurances to hildmor while kept in cell,
then the witnesses shouldn't have the same right to get him in back due to doubts and risks about their lives, security, safety of evidences, bribes, threats and so on ?

Malice, along with the rest of their post, is lawyer babble and designed to confuse and bully. It doesn't need an ooc discussion. It's an IC tactic.Er_Nano_Infame,Apr 29 2012 wrote: OOC: not sure, but maybe a petition forwarded by witnesses, via private letters, isn't exactly mere pubblic opinion.

Let's just leave that stuff IC and argue it out properly.
