From the desk of Gnolls Royce, Esq.

Thursday, May 16, 129 Ha

We hereby inform all parties involved with the 'Razorvine' affair of the lawsuit hereby. As per municipal code common law parties must set a court date within the calendar week (7 days) or face a motion of dismissal.

We request the court permit this lawsuit to go forward as class action, as per the terms and conditions listed in annexed document 1A. Said document contains an extensive list of parties desiring to be joined in the resolution of this litigation and their necessary contact information. All members have waived their right to individual proceeding and have elected one Miss Nienna to be their representative in this matter.

Should this motion see approval, we hereby list grievances as follow:

The Fated

1) Abusive taxation as defined within article 17 of the tax code.

2) Improper use of the exceptional tax measures and exemptions within the municipal code, article 208c.

3) Failure to properly assess effective cost control and project oversight in contravention of Fated charter.

The Harmonium

1) Vandalism of private property.

2) Unlawful threats of assault.

3) Excessive usage of force.

4) Failure to compensate property holders for usage of private space under debtor law.

The Mercykillers

1) Unlawful interference with public traffic causing significant loss of clientele to the business owners listed in annexed document 1d.

2) Public disturbance caused by the gallows and the threat they represented to the peaceful enjoyment of public thoroughfares and nearby shops by citizens.

3) Failure to produce required paperwork proving that the appropriate forms were filled for the public gallows the Mercykillers subsequently built in the vicinity of the Bazaar.

4) Failure to compensate property holders for usage of private space under debtor law.

As per procedure, copies of these documents have been provided to all parties involved for their perusal pending a court hearing.

Caterina reads the letter and forwards it to Garen. She encloses a brief memo of her own.

As you can see the Free League wishes to bring charges against our colleagues in the Triad.  Whilst I believe the Fated have more than enough legal expertise to reprsent themselves in court I think it only fitting we stand by the Harmonium and the Mercykillers and offer them our full support.  To this end I would like to offer my support to my colleagues and conduct their defense.

Should members of the city wish to pursue such things in a court, it is their right. You may offer your services to whichever party you wish to represent but it is up to the parties concerned to agree to your offer of aid.

In the mean time, before this even goes any further, we require a few pieces of information before such a lawsuit can be certified.

First of all we need Discovery. This requires verification of all involved parties named in the suit as plaintiffs in order to determine its size and if the proposed class meets the standard for class certification. This means every member of Sigil that has joined onto the lawsuit must be named and legally verified. This includes addresses of residence, name, age, race, et al. Those refusing to give such information shall be exempt from the lawsuit. Only those agreeing to count and identification will be permitted to be part of the action.

Once discovery is complete, however long it may take, a ruling will be given as to whether the numbers are large enough to allow a class action to be certified.

Second we must allow all parties named as defendants the chance to object to whether the issues should be handled as a class action, to whether the named plaintiffs are sufficiently representative of the class, and to their relationship with the law firm or firms handling the case. The court will also gauge the ability of the law firm to prosecute the claim and their resources for dealing with class actions. If they are deemed incapable of properly prosecuting, the suit will halt until proper council is found.

Once these steps are taken, if the courts decide that a trial is warranted, both sides shall be given ample time to prepare their cases and a judge will be assigned. In most trials, considering the normal backlog of our trial system, a suit of this size might not make it to a pretrial hearing for several months. If large enough, the time might be longer.

Whichever side you wish to aid, I hope this helps you. I, of course, will not become involved either way as I no longer prosecute or defend.

Caterina reads the response and initially seems surprised. She reads it again and then for a third time. The final time she reads through it a smile crosses her face as something seems to dawn on her.

"Oh I see what you're doing there."

She writes a response to the original citation

In response to your correspondence I would like to inform you that legal option is of course open to you.  My own department looks forward to receiving those whom you name as plaintiffs and defendants so as that we can begin our own very thorough investigation of those faction members involved

She doesn't post the response right away she places it in a drawer in her desk with the rest of her paperwork. She heads down to Khazeets and in the Bazaar for her afternoon tea and she calmly reflects upon hos such a small space and a weed can be the cause of such commotion. It is a few days before she "remembers" to post the reply. After she has done so she sends an internal memo to Garen.

Please find enclosed the official request for the names of all those named as plaintiff in your recently opened class action suit. Please ensure that all named plaintiffs are willing to be officially recognized by the courts and fully willing for “in person” court census to verify such.

The reply for dismissal is filed with the usual confirmation of receipt to the Aide who closed it.
